This seems to be little more than an attempt to muddy the waters. A few weeks back he was focused on whether Rove had mentioned Valerie Plame Wilson by name, which was pretty low-order sophistry and certainly not a defense.
A careful reading of Luskin's words suggests he's not denying Rove circulated the name but only that the motive was to "punish Joe Wilson." This borders on being an admission that Rove violated the Espionage Act. It's pretty bizarre for a defense attorney to make such damning admissions in a public forum.
As a non-practicing lawyer, I've been baffled by Luskin's apparent ineptitude. He seems to be concerned with political spin and not the law, which suggests that he's following Rove's orders. This is plainly not in Rove's best interests, at least not in the legal sense.
He may be counting on a pardon, but as Bush's poll numbers sink, that seems less and less likely. This is looking more like Watergate than Iran-Contra, even with one party rule. Any thoughts on his motives?
